Law & licence

Drone law for beginners: licence, registration, geo zones.

Which drone licence you need, how to register as an operator, where you can't simply fly and which insurance is mandatory. With examples from a family home to a warehouse roof.

These rules apply to Germany, as of September 2026. We are a software provider, not a legal adviser. The binding source is dipul.de, the drone portal of the Federal Aviation Office (LBA) and German air navigation services (DFS).

Before your first flight, in this order

  • Take out insurance. Liability insurance is mandatory for every drone, even the smallest.
  • Register as an operator. Once, with the LBA, €20 (companies €50). The number you receive (e-ID) goes on every drone.
  • Get the right proof of competence. Which one depends on your drone’s C class: none, A1/A3 or A2.
  • Check the geo zones before every job, in the dipul map or the Droniq TraX app.
  • Get consent. Flying over a residential property almost always requires the owner’s permission.

Then carry on with the quick start: prepare, fly, upload.

First the terms: operator and remote pilot

Drone law distinguishes two roles, which are often the same person. The operator is whoever owns or deploys the drone, so you or your company. The operator registers and takes out the insurance. The remote pilot is whoever flies it and needs the proof of competence, the “drone licence”. If you fly for your own one-person business, you do both. If three employees fly for a company, the company registers once and every pilot gets their own licence.

Almost everything you do with a camera drone around buildings falls into the open category. The same basic rules apply to everyone there: no higher than 120 m above ground, the drone always within your own sight, no dangerous goods, and never over assemblies of people. The open category has three subcategories, A1, A2 and A3. They set how close you may get to uninvolved people. Which one applies to you depends on your drone’s C class.

Uninvolved means anyone who has nothing to do with the flight, such as passers-by or neighbours in their garden. A client you have briefed and who agrees counts as involved. An assembly of people is so dense that nobody could move away quickly: a market, a street festival, a crowded pedestrian zone.

The C class: the label on your drone

Drones sold new since 2024 carry a class identification label from C0 to C6, a small sticker on the body or the packaging. It depends mainly on weight. For capturing buildings the first three matter.

C class Weight Examples Subcategory What it means
C0 under 250 g DJI Mini 4 Pro, DJI Mini 5 Pro A1 You may fly in residential areas and even over individual uninvolved people, but not over assemblies of people.
C1 under 900 g DJI Air 3S A1 Like C0, but not over uninvolved people.
C2 under 4 kg DJI Mavic 4 Pro, Mavic 3 Enterprise, Matrice 4E A2 At least 30 m from uninvolved people, 5 m in low-speed mode.
C3, C4 under 25 kg DJI Matrice 350 RTK, Matrice 400 A3 Far away from people, see below.
C5, C6 under 25 kg special-purpose aircraft STS Belong to the standard scenarios of the specific category.

And if your drone has no C label at all? That applies to older models that came on the market before 2024, such as a Phantom 4 RTK or a Mavic 2. Under 250 g they fly like C0. From 250 g they may only fly in A3: at least 150 m from residential, commercial, industrial and recreational areas, and nobody uninvolved nearby. You can no longer legally photograph a house in a village with one, but a field far out of town is fine.

Which drone licence do you need?

There are three levels, each building on the one before. Carry your proof on every flight, on your phone is enough.

The certificates compared

No proof
For C0 drones and anything under 250 g. The LBA still recommends its free online training, and anyone flying professionally should do it.
A1/A3, the "small drone licence"
For C1 and for all drones from 250 g in A3. Online with the LBA: free learning material, then an exam of 40 multiple-choice questions, 75 % must be correct. €25, from age 16, valid for five years. Doable in an afternoon.
A2, the remote pilot certificate
For C2 drones close to people. A1/A3 is the prerequisite. On top come practical self-training, which you declare in writing, and an additional theory exam at an examination centre designated by the LBA. Valid for five years.
STS, the certificate for standard scenarios
For the specific category with C5 or C6 drones. A1/A3 is the prerequisite, plus a theory exam at a designated centre and practical training with an exam at a recognised centre. The operator also submits an operational declaration to the LBA.

Do you need STS? For roofs, facades and plots almost never. STS is meant for operations beyond the open category, for example a heavier drone over a cordoned-off area in town (STS-01) or beyond visual line of sight over sparsely populated land (STS-02). Both require a drone with a C5 or C6 label. A larger enterprise drone such as the Matrice 350 RTK is C3. In the open category you may only fly it in A3, well away from buildings; in town you need an operational authorisation from the LBA in the specific category.

In practice: with a DJI Mini you can take off without a licence. From a DJI Air upwards you need A1/A3. And with a Mavic 4 Pro or an enterprise drone there is no way around A2 once the building stands in a town.

Operator registration and e-ID

You must register as soon as your drone weighs 250 g or more or has a camera. That covers practically every drone you can build a 3D model with, including the DJI Mini.

  • Register online with the LBA, in the country where you live or your company is based. It costs €20 for private individuals and €50 for companies.
  • You receive an e-ID, the operator number. It is valid in all EU countries and for all your drones, so you do not register each drone separately.
  • Stick the e-ID on every drone, clearly legible. A small label is enough.
  • For C1 and C2 drones, also enter it in the app. The drone then broadcasts it in flight (Remote ID) so authorities can identify it.

Geo zones: where you can’t simply fly

In Germany the airspace is open in principle, but there are geographical zones, geo zones for short, where you may only fly under conditions. Which ones apply at your site you check before every flight in one of two maps.

The dipul map at maptool-dipul.dfs.de is the official source from the LBA and DFS. It runs in the browser, costs nothing and shows every zone as a layer you can switch on and off. For preparing at your desk it is the first choice.

Droniq TraX is the app for the field, the successor to the Droniq app. It checks your location, shows the geo zones and tells you what applies there. The basic features are free. With “Fly now” you make your flight area visible to other airspace users, a rescue helicopter for instance. The paid tiers also show manned air traffic live. TraX does not replace an approval, it only shows you whether you need one.

The zones you will meet most often when capturing buildings:

Geo zone What applies
Residential properties Overflight only with the explicit consent of the owner or tenant. The only exception is drones under 250 g without a camera, so none you could build a model with.
Control zones around airports Only with clearance from air traffic control. Since 6 August 2026 the DFS divides its control zones into an inner and an outer area: outside, a general clearance can apply under conditions; inside you still need your own, requested through the DFS AIS portal.
Airports and airfields Within 1 km of airports (and 5 km along the extended runways) only in the specific category. Around smaller airfields 1.5 km, where the airfield’s consent is enough.
Motorways, federal roads, railways, federal waterways 100 m distance. Closer is possible if the operator agrees, or if you always fly lower than your lateral distance and keep at least 10 m away.
Industrial sites, power plants, substations, authorities, police, hospitals 100 m distance, closer only with the consent of the operator or institution.
Nature reserves, national parks, Natura 2000 sites Only with the consent of the nature conservation authority. Except in national parks there is a narrow exception: not for leisure, above 100 m, and only if the overflight is unavoidable for the job.
Accident and incident sites of police, fire and rescue services 100 m distance, closer only with the consent of the officer in charge.

So a warehouse roof in a commercial area can easily lie in three zones at once. Get consents in writing if you can, an email is enough, and have them with you when you fly.

Insurance

Liability insurance is mandatory in Germany for every drone, regardless of weight and whether you fly privately or professionally. It pays if your drone injures someone or damages something, such as a car or a skylight.

Private liability policies often exclude drones or only cover them for private use and up to a certain weight. As soon as you fly for a job, even once and even with a DJI Mini, you need dedicated drone liability insurance for commercial use. Ask your insurer specifically about the model and the purpose. Carry the proof when you fly. Hull insurance for the drone itself is optional, but quickly pays for itself on an enterprise drone with RTK.

Examples from the field

Four jobs of the kind our customers fly every day, and what they need. Registration, e-ID and insurance are not listed each time: you always need them.

DJI Mini 5 Pro over a family home

Job
Roof survey for a solar installation, residential area, the client lives in the house.
Category
Open, A1. The Mini 5 Pro is C0 with the standard battery.
Licence
None required. A1/A3 recommended, the training is free.
Consent
From the owner, ideally together with the order. If you fly over neighbouring properties, from the neighbours too. Otherwise plan the route so the drone stays over the client's plot or the street.
Check first
A control zone, hospital or railway nearby? One look at dipul or TraX.

DJI Air 3S over an apartment building in the city centre

Job
Facade and roof of an apartment building, with pedestrians on the pavement.
Category
Open, A1. The Air 3S is C1.
Licence
A1/A3.
Watch out
Do not fly over pedestrians. For the facade, briefly cordon off the pavement or wait until nobody is underneath.
Consent
From the owner or the property manager. Tenants are also entitled users, and whether the owner's consent covers them is not clearly settled. So at the very least announce the flight with a notice in the building.

DJI Matrice 4E over a commercial hall next to a railway

Job
Survey of a hall roof with RTK, a railway line runs alongside the site.
Category
Open, A2. The Matrice 4E is C2, just like the Mavic 3 Enterprise and the Mavic 4 Pro.
Licence
A2. Without A2 only A3 would remain, and it demands 150 m from the commercial area. Keep 30 m from staff on site, 5 m in low-speed mode.
Geo zone
Railway: 100 m distance, or your flight height always stays below your lateral distance to the track (at 40 m height, more than 40 m away). Otherwise get the rail operator's consent.
Consent
From the owner of the site. If the hall lies in an industrial-site zone, from its operator as well.

Older Phantom 4 RTK over open fields

Job
Terrain model for a planned ground-mounted solar park, far outside town.
Category
Open, A3. The Phantom 4 RTK has no C class and weighs over 250 g.
Licence
A1/A3.
Watch out
150 m from residential, commercial, industrial and recreational areas, nobody uninvolved in the flight area. A farm at the edge of the field or a cycle path through it already makes things tight.

Frequently asked questions

Do I need a drone licence to photograph buildings?
That depends on the C class of your drone. With a C0 drone under 250 g such as the DJI Mini you need none. C1 drones such as the DJI Air 3S need A1/A3. With a C2 drone such as the Mavic 4 Pro or the Matrice 4E you need A2 as soon as the building is in a built-up area.
How much does a drone licence cost?
The small drone licence A1/A3 costs €25 and is taken online with the German Federal Aviation Office (LBA); the learning material is free. It is valid for five years. The A2 certificate adds a further theory exam at a testing centre designated by the LBA.
Do I have to register my drone?
It is not the drone that is registered but you as the operator, as soon as your drone weighs 250 g or more or has a camera. That includes the DJI Mini. Registration with the LBA costs €20, or €50 for companies. You put the e-ID you receive on every drone you own.
Do I need insurance for my drone?
Yes, liability insurance is mandatory in Germany for every drone, whatever its weight. If you fly for a job, you need drone liability insurance for commercial use; private liability insurance usually does not cover that.
Can I just fly a DJI Mini over the neighbour's house?
No. As soon as the drone has a camera, you need the consent of the owner or tenant for every residential property you fly over. Weight makes no difference here.
Can I still fly my older drone without a C class?
Yes, but with restrictions. Under 250 g it flies like a C0 drone. From 250 g it may only fly in subcategory A3, at least 150 m from residential, commercial, industrial and recreational areas. A house in town is off limits with it.
How do I find out whether I may fly at a location?
In the dipul map from the LBA and DFS in your browser, or on the go in the Droniq TraX app. Both show the geo zones at your site, such as control zones around airports, railway lines or nature reserves, and what applies there.
How high may I fly a drone?
In the open category no higher than 120 m above ground. For buildings you fly much lower anyway, typical heights are listed with the flight patterns.
Can I fly my drone at night?
In the open category yes, if a green flashing light on the drone is switched on. For images meant to become a model it is pointless, though: the photos need daylight.
Is my drone licence valid abroad?
In the EU and in Norway, Iceland, Liechtenstein and Switzerland, yes: the certificates and the e-ID are valid everywhere there. Geo zones are national, though, so check them locally in that country's map.
I am only flying once for an acquaintance. Do I still need commercial insurance?
As soon as money changes hands or you fly as part of your work, yes. Many private policies end exactly there. If in doubt, ask your insurer before you fly.

How to plan the flights themselves is covered in flight planning, which drone can do what in Which drone can do what?.

As of September 2026, for Germany, without warranty. The binding sources are dipul.de and the Federal Aviation Office.
